The Agreement applies to you whether you are -

1. A medical practitioner or health care provider (whether an individual professional or an organization) or similar institution wishing to be listed, or already listed, on the Website/Mobile Application, including designated, authorized associates of such Practitioner/Doctor/Healthcare providers or institutions. (The Practitioner is and shall be duly registered, licensed and qualified to practice medicine/ provide health care, wellness services, as per applicable laws/regulations/guidelines set out by competent authorities and the Practitioner shall not be part of any arrangement which will prohibit him/her from practicing medicine within the territory of India). or
2. A patient, his/her representatives or affiliates, searching for Practitioner/Doctor/Healthcare providers through the Website/Mobile Application (“End-User” or “User”); or
3. Otherwise a user of the Website/Mobile Application (“User”).

This Agreement applies to those services made available by Rashi Clinic on the Website/Mobile Application, which are offered  to the Users (“Services”), including the following:

1. For Practitioner/Doctor/Healthcare providers: Listing of Practitioner/Doctor/Healthcare providers and their profiles and contact details,qualifications,registration number, location, photographs etc to be made available to the other Users and visitors to the Website/Mobile Application;
2. For other Users: Facility to

 (i) create and maintain ‘Health Accounts’,

 (ii) search for Practitioner/Doctor/Healthcare providers by name, speciality, and geographical area, and

 (iii) to book appointments with Practitioner/Doctor/Healthcare providers/Doctors/Healthcare providers..

The Services may change from time to time, at the sole discretion of Rashi Clinic, and the Agreement will apply to your visit to and your use of the Website/Mobile Application to avail the Service, as well as to all information provided by you on the Website/Mobile Application at any given point in time.

This Agreement defines the terms and conditions under which you are allowed to use the Website/Mobile Application and describes the manner in which we shall treat your account while you are registered as a member with us. By downloading or accessing the Website/Mobile Application to use the Services, you irrevocably accept all the conditions stipulated in this Agreement,  and privacy policy as available on the Website/Mobile Application, and agree to abide by them. This Agreement supersedes all previous oral and written terms and conditions (if any) communicated to you relating to your use of the Website/Mobile Application to avail the Services. By availing any Service, you signify your acceptance of the terms of this Agreement.

 You acknowledge that you will be bound by this Agreement for availing any of the Services offered by us.

Your access to use of the Website/Mobile Application and the Services will be solely at the discretion of Rashi Clinic.

The Agreement is published in compliance of, and is governed by the provisions of Indian law, including but not limited to:

1. the Indian Contract Act, 1872,
2. the (Indian) Information Technology Act, 2000, and
3. the rules, regulations, guidelines and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).

 

We aim at making this happen at a reasonable price and reliable service by keeping the following good practices on mind:

• We will try  to make sure that every Doctor/ healthcare provider listed in this Website/Mobile Application is genuine, authentic,and trustworthy for making online consultations and treatment. However, the user/patient of this Website/Mobile Application must read the terms and conditions and privacy  policy  of that respective doctor or healthcare provider before proceeding  for their services.
• Rashiclinic.com  is only a platform to list the  doctors or healthcare providers for providing their healthcare services.
• Every medicine/drugs or investigations, or any medical/surgical procedure/exercise/physiotherapy required during the treatment may or may not  have  any  side effects or  untoward events. Rashiclinic.com   or its staff members or any  officer  of this site will  not be  responsible for any side effect, damage, loss or injury made during, availing the healthcare services in any  form, from the doctors/Healthcare providers listed on this  platform. The homeopathic medicines are essentially free from side effects. Our organization takes no responsibility for any presumed complications.  Customers/Users/patients will  be responsible for their own safety measures.
• We are also not accountable for any human error(s) that gone unnoticed by the customers and our staffs.
• The payment mode in order to book our services can be made in a safe way through our site which involves secure payment gateways.
• Our site concentrates on the user’s needs and works constantly in establishing the customer/user/patient’s satisfaction.

• Rashi Clinic enables Users to connect with Practitioner/Doctor/Healthcare providers for booked appointment through the Website/Mobile Application. Rashi Clinic will ensure Users are provided confirmed appointment on the Book facility. However, Rashi Clinic has no liability if such an appointment is later cancelled by the Practitioner/Doctor/Healthcare providers/Doctors/ Healthcare Providers, or the same Practitioner/Doctor/Healthcare providers/Doctors/ Healthcare Providers is not available for appointment.

• Rashi Clinic is not involved in providing any healthcare or medical advice or diagnosis and hence is not responsible for any interactions between User and the Practitioner/Doctors/Healthcare Providers. User understands and agrees that Rashi Clinic will not be liable for:

You must be 18 years of age or older to register, use the Services, or visit or use the Website/Mobile Application in any manner. By registering, visiting and using the Website/Mobile Application or accepting this Agreement, you represent and warrant to Rashi Clinic that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website/Mobile Application and the Services available through the Website/Mobile Application, and agree to and abide by this Agreement.

• Users are prohibited from using any engine, software, tool, agent or other device or mechanism (such as spiders, robots, avatars or intelligent agents) to navigate or search the Website/Mobile Application. Users are also prohibited from using software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource.

4.  Payment Methods

4.1. Payments through Online Credit/Debit Card

Master, Maestro, Visa, Rupay, State bank of India and American Express Card (If included in payment gateway) payments are transacted via a reliable online gateway payment system. There is nothing to worry about your card information since the bank directly connects with the online payment portal, therefore no data transfer or storage will take place within the site. • If any  Practitioner/Doctor/Healthcare provider charges extra payment as mentioned in the his/her dashboard due to any  extra medicine or facility providing, at his/her personal  payment  portal whatever method it may  be like online transfer, paytm, or through  any other  wallet, then the confirmation of such payment  will  be provided by that particular Practitioner/Doctor/Healthcare provider. Rashi  clinic will  not provide the payment  confirmation. and in case of dispute/refund, if any, then rashiclinic will  not be responsible for such type of payment and patient/user and any Practitioner/Doctor/Healthcare provider will  sort  out  the matter at their own level.

4.2. Net Banking payments

The Commonly used banks enables the net banking options, but payment  gateway used in Rashiclinic.com may add or delete these banks or any  other banks facilities as per their  bank policies .:

4.3. Online Payment Methods

4.3.1 Through Wallet

The payments to purchase the service can be made through wallets such as , MobiKwik, AmazonPay, Jio money, Free charge etc. depending  upon the facility provided by the payment  gateway integrated in Rashiclinic.com. The amount will be deducted directly from the wallet and no information will be saved during the transaction.

4.3.2 Through UPI

The payments can be made through UPI supporting applications such as Google Pay, PhonePe,  Paytm, etc. Your account information will not be stored during the transaction. Every transaction will be carried out in a third party payment gateway system only.

4.3.3 Paytm

Paytm is also enabled for making the payments for your booking in Rashiclinic.

5. Confirmation of Transaction

Transaction confirmation is not solely based on the confirmation message that is displayed on the Website/Mobile Application after the completion of transaction. The confirmation will be eligible only when you receive an e-mail stating the purchase of the services. If you do not receive an e-mail stating the confirmation, initially check for the e-mail in the spam or junk folder. You cannot rely on the Website/Mobile Application confirmation in the absence of the e-mail. At times of no such e-mails, you can contact the customer care of Rashiclinic to get the confirmation documents.

If any  Practitioner/Doctor/Healthcare provider charges extra payment as mentioned in the his/her dashboard due to any  extra medicine or facility providing, at his/her personal  payment  portal whatever method it may  be like online transfer, paytm, or through  any other  wallet, then the confirmation of such payment  will  be provided by that particular Practitioner/Doctor/Healthcare provider. Rashi  clinic will  not provide the payment  confirmation. and in case of dispute/refund, if any, then rashiclinic will  not be responsible for such type of payment and patient/user and any Practitioner/Doctor/Healthcare provider will  sort  out  the matter at their own level.

 6. Booking Policy

Customers/users are requested to  fill  clearly  all  the necessary  fields like  name,  E mail, mobile number, age/ date of birth, gender,  address, contact  during the  booking of online consultation and must make the payment of  required amount through the payment gateway  provided in the Website/Mobile Application at  the time of booking the appointment.

 7. Refund/Cancellation Policy

Customers/users are requested to  read the latest  fee/charges regarding the cancellation/re-scheduling of their respective bookings.

7.3 In case of unutilized bookings, (Above point no. 7.2), you might be required to request for any applicable refunds, as per the policies, within 05 days from the online consultation. Refunds cannot be processed if the request is made after the expiry of 05 days of booked online consultation date as mentioned earlier. If the unutilized bookings are not claimed, then it would be considered to be forfeited and cannot be processed after the time expires.

7.4 Once the refund request is accepted, then the amount would be refunded within the next fifteen (15) to twenty (20) business days in the original mode of payment ( If possible) done by the User while booking, otherwise amount  will  be refunded by any  other possible mean.

7.6 Kindly note that the convenience fee charged during the time of booking will not be refunded.

7.7 In the event that, the Practitioner/Doctor/Healthcare provider with whom User has booked a paid appointment via the Website/Mobile Application/App, has not been able to meet the User either the appointment is confirmed or not confirmed by the Practitioner/Doctor/Healthcare provider, User will need to write to us at support@rashiclinic.com within five (5) days from the occurrence of such event; in which case, the entire consultation amount paid as mentioned on the Website/Mobile Application will be refunded to the User within the next fifteen (15) to twenty (20) business days in the original mode of payment ( If possible) done by the User while booking, otherwise amount  will  be refunded by any  other possible mean.

7.8 If an Appointment is cancelled by  the Practitioner/Doctor/Healthcare provider either before or after confirming that  appointment, or the user cancels the re-scheduled appointment, in  both the above conditions, the user will  get  the full  refund of paid amount. User will need to write to us at support@rashiclinic.com within five (5) days from the occurrence of such event; in which case, the entire consultation amount paid as mentioned on the Website/Mobile Application will be refunded to the User within the next fifteen (15) to twenty (20) business days in the original mode of payment ( If possible) done by the User while booking, otherwise amount  will  be refunded by any  other possible mean.

7.9 If The Practitioner/Doctor/Healthcare provider does not  meet  the user at  the scheduled time of appointment due to  any  reason, or  cancels the appointment either before or after confirming that  appointment, or re-schedules that appointment of his own will, which  is cancelled by the user. In all above these conditions, The convenience fees charged at the time of booking an  appointment will  be levied as penality  charge to the concerned Practitioner/Doctor/Healthcare provider and will  be deducted from  the next  monthly payment of that Practitioner/Doctor/Healthcare provider.

7.10 If any  Practitioner/Doctor/Healthcare provider charges extra payment as mentioned in the his/her dashboard due to any  extra medicine or facility providing, at his/her personal  payment  portal whatever method it may  be like online transfer, paytm, or through  any other  wallet, then the confirmation of such payment  will  be provided by that particular Practitioner/Doctor/Healthcare provider. Rashi  clinic will  not provide the payment  confirmation. and in case of dispute/refund, if any, then rashiclinic will  not be responsible for such type of payment and patient/user and any Practitioner/Doctor/Healthcare provider will  sort  out  the matter at their own level.

8. Fees Payment

• Practitioner/Doctor/Healthcare provider will  get their consultation fees amount via cheque payment or online bank transfer on monthly basis not before day 7^th of next  month after deducting  all the applicable taxes, service charges, or penality  charges (if any), without  any  bank interest.

9. Promotion Codes

• Rashiclinic tends to generate various promotion codes which can be availed on the site during a booking in order to get a discount. Rashiclinic.com has the right to add, modify, change, remove all or some of the Terms and Conditions or replace, completely or partially, the program with any other program, whether similar or different to this program or remove it completely without any notice in prior.
• At times of dispute with any of the parties, Rashiclinic’s say will be the binding final decision.
• When registering with Rashiclinic.com, we, our partners or affiliates or groups of companies may get in touch with you in a timely manner to render the offers and information about similar products or services that might benefit you.

15. Communication

Once the booking is processed, you would receive a detailed invoice and document regarding the booking via e-mail. A SMS communication would also be sent as a mode of confirmation. These documents are confirmation assets and can be used to claim if there are any discrepancies.

16. Governing Law
This user agreement and every Terms and Conditions will be governed and formulated in relation to the laws of India without any conflict in the laws, principles and must not cause any disputes arising in relation herewith will be subjected to the jurisdiction under the courts of Faridabad.

17. Complaints
